Legal Question in Family Law in Pakistan
disobedient wife
I was in Bahrain from 08/ 06 to 12/06 on a residence visa. I was working in a company belonging to my father in law. My family joined me afterwards.
My wife became ill and was admitted in a hospital. Being in treatment no work was done during that period as we were still in the phase of mobilisation. So I decided to move back to Pakistan. My decision to move back met so much resistance through my in laws that it developed into an argument, and finally I left Bahrain on 27/12/06. My father in law with held my wife and my sons passports against my will. Its been FIVE months since I am out of contact with my son, as my father in law has ordered my wife and his whole family including himself, to terminate all communications with my family and me. My wife has declared to one of my relative that she doesnt want ot live with me and will never return to Pakistan.
My question is, Is my wife has the authority to seperate my son from me and that too in a diffrent country where i cant even know that ho is he doing? Please do let me know as i will be waiting anxiously for your reply.

Re: disobedient wife
Mr...
In your mentioned scenario which is a complex one, you have not mentioned where you ur marriage was solominized and where your son was born.
this is very much important so far jurisdiction is concerned. Secondly no matter what you have the right to have visitation to your child. But during the period of hazanat , mother keeps the custody and legally can keep the child for seven years of age of the child(in case of boy)but if the circumstances calls for so doing that in the welfare and interest of the minor custody may be given to the father. but u have to prove your case.
send me more information for detailed reply.Do not lose your heart, things will be alright.
