Legal Question in Family Law in Pakistan
Can I keep my jewellery in case of Khula? that jewelery was given by my husband at the time of marriage. My huq Maher is only mentioned on my Nikkah Nama which is 5000 Rs only. He is asking his jewellery back and he is threatening me that he will not give me divorce. How long it will take to get divorce by filing Khula?

Salam!
As far as your second part of question is concerned it will take from 2 months to 3 months. Now if that jewelry is not mentioned in Nikanama as a part of your Haq Mahar then that would not be returned.

When a wife demands "Khulla", she has to withdraw her right of "Haq Mehr". if she has already taken it from her husband, she has to return it back. As for as other gifts and jewelry articles are concerned, if these were not given as "Mehr", according to
THE DOWRY AND BRIDAL GIFTS (RESTRICTION) ACT, 1976, wife has the exclusive rights over it and it not be returned in case of "Khulla".
Rightly guided by my fellow colleagues..
