Legal Question in Family Law in Pakistan

I am married for more than 4 years and live in my mother's house. My wife family is a greedy one; they saw my mother�s wealth and tried get some for themselves. I have a 2yr daughter. My wife keeps fighting with me deliberately and going to her parent�s house and taking the child with her. She always wants me to divorce her so that she can take the child and monthly money as i am well off. My wife family has a bad history.

1 brother mentality ill

1 brother divorced

1 younger sister is divorced.

She always go for many months. She has done this for many times. But now I want to do something about it.

I want to ask some questions.

Can i get married to another girl without giving divorce to her cause she is never with me?

Any kind of a notice i can send before getting married..So she can come back..If she doesn�t ill get married without divorce?

What kind of maintenance money if my earnings are around 30,000 per month?

How can i take custody of my child..if she is get Khula and getting married?

In case of a daughter, the custody remains with mother till the girl gets married and the father is liable to pay maintainance till the girl gets married to both the wife and the daughter. However if the wife marries another man after divorce or khula then she becomes ineligible for the custody of the child.

Man can get married to another woman without losing right to custody. But keeping a 2nd wife without permission from the 1st wife is an offense under our law and the man can be imprisoned if he fails to follow the procedure mentioned in muslim family law ordinance, 1961. The process of taking procedure is very difficult and it is impossible to get that from a wife. For more u can always consult me at [email protected]
