Legal Question in Family Law in Pakistan
My wife gt khullah from me abt 3 months back and also filed a case for recovery of dowery articles. The case is now decided and judge ordered me to submit Rs 8 lac in return of dowery by saying that we both husband and wife are from good financial background and the girl must have given dowery articles.I admitted in my statment only that i gt few articles as dowery but no question was asked from me that what articles i am having .
Is there any law under which judge can give such one sided decision without any proof?

Now we dont know whether you have taken the stand and had been cross examined or your wife had done the similar thing. If the matter has gone for evidence what legal issues were framed by the court and whether your ex wife had produced any documentary evidecen which had not been rebutted by you. Unless the proper pleadings are perused it will be dificult to answer your question. However, in reply to the last line of question the answer is that no the court cannot give any order one sided without any proof, but again all the pleadings including evidence recorded and cross examination if any is available for perusal.

The decision of judge depends upon Statements of all witnesses, receipts of purchase of dowery etc.
