Legal Question in Civil Litigation in Pakistan
Dear Sirs,
I need a favour from your forum. I have filed a Lawsuit in High Court Sindh, Karachi but matter is in pending since Defendants (Federal Government) and their Counsel are prolonging it deliberately and avoiding from arguments. There is an objection from the defendants regarding Jurisdiction. As per Contract it was Rawalpindi but the Lawsuit was filed at Karachi on the following grounds:
1- Goods delivered at Karachi.
2- Delivered Goods inspected at Karachi and rejected.
3- Party of the 1st Part sent the Draft Contract for signatures at Karachi to the Party of the 2nd Part.
4- Due to disputes Defendants cancelled the contract unilaterally after expiry.
5- The Lawsuit has been filed for Declaration, Injunction, Recovery and Damages since plaintiff�s
supplied goods were purportedly rejected by the defendants Stores with invalid and
non-technical grounds.
6- The Civil Court except High Court could only hear since it was over limit.
Would please help and guide me with any citation that I could also file Lawsuit at High Court Karachi instead of Civil Court, Rawalpindi on the abovementioned grounds.

original forum for a trial case is civil court and not the high court.it is advisable that you hire an attorney in Rawalpindi to file your case and follow up.
