When there is no written agreement of tenancy between landlord and tenant, can landlord institute a suit for eviction of such tenant or recovery of rent, as the case may be.if no, then what remedy is available to him, in the area of Punjab.
1 Answer from Attorneys
Yes why not , landlord can filled a petition for eviction of tenant in the court, and within 10 days tenant have to file leave to defend , otherwise court ordered immediately eviction of tenant,
who told u that in the absence of agreement u can not file suit.only u hv to deposit some fine in the court as u did not bring your contract in writing,. This is your property and according to new law, the landlord can get his property back for his own use also as default of rent is not necessary,
