Legal Question in Legal Ethics in Pakistan

Union's General Secretary of a Residential Apartment is having his own flat at the top / 4th Floor. A mobile company has installed a big communication tower at his roof and entire rent of tower goes to his pocket instead of crediting it to Union fund because in apartments roof does not belong to individual flat owners rather it is joint property of all flat residents and they all can go to roof.
If above deduced result is right then how can apartment residents force the general secretary to put rent of mobile tower in union fund so that development and maintenance of apartment could be performed in a better way.

yes, obviously you can compel him to do so by filling a suit in the court of law..
