Mr.A is gardening at the front of his house .He goes in to get a drink of water leaving his spade behind.
Mr.X a passerby picks up the spade and attacks Mr.B who is next door to Mr.A. Is A liable to B.

if no enmity, criminal intentions or malafide is involved on the part of Mr. A towards Mr.B( which is still a matter of inquiry and further evidance)A is not liable to B or for criminal negligance etc.,
