TWO BROTHERS "A" & "B" inherited land from three different khasra nos. Brother "A" sells his total share from one khasra no. only. While brother "B" holds his share fom other two khasra nos. (1)Can brother"A" sell his complete share from one khsra no. only? (2)Does brother "B" (or his successors thereof) can claim his share from land sold out by brother "A" from one khasr no. only.

They are shareholders equally in all the three khasra numbers.. Each of them can sell the amount of land to the extent of his share only in each khasra. That means if share is sold in one khasra the claim can be made separately in other khasras. The right of succession transfers to the legal heirs the moment a person dies. So his children can also claim the share owned by their father unless its sold. Possession is something different and it can be claimed by new buyer also.. For more do consult me at [email protected]
