Legal Question in Real Estate Law in Pakistan
land belonging to 1 man was recently "taken over" or transferred into another name by a 2nd man. The 2nd claims to have a power of attorney given to him by either the first man's parents or the first man himself. It is possible that either of these scenarios is true. How can the land be retrieved?
How can it be ascertained that there was a VALID power of attorney at the time?
If the parents issued the power of attorney and they have now expired, is the power of attorney automatically revoked?
If the man issued it (but he cannot remember) can he revoke it even if the land has been transferred already? Please advise
1 Answer from Attorneys
Power of attorney ceases the moment person (Issuer) dies, and after that the attorney cannot go into any contract or agreement.
but if the issuer doest remember that whether he had it issued or not that is another case, if the power of attorney was intact and the attorney enters into any deal basiing on the authority given ,then these are binding and cannot be revoked. circumstances must be proved in the court of law if required to be proven in contrary.
