Legal Question in Real Estate Law in Pakistan

Q: What kind of laws of inheritance is prevailing in Pakistan? What about Islamic laws of inheritance are they applicable in Pakistan? Do grandson is illegible to have right in the deseased property of granndfather? Whereas Islamic laws are not accomodating any right to grandson? Please explain in the light of Islamic and conventional lawys.?

Grandson has no right in inheritance of grandfather if his father passes before the death of grandfather according to Hanafi School of thought. However in another school of though probably shafi or maliki the grandson has right in inheritance. Pakistani Law is mostly hanafi based but there are some exceptions and this is one of them. Ayub khan passed few laws in 1960s which include muslim personal law, muslim family law ordinance and few others. There are many provisions in these laws which are against Hanafi fiqh but still they are in practice and the courts implement them. Hope things are clear.
