Legal Question in Real Estate Law in Pakistan

sir i file a case against 2 brother of property benami transaction so on of my brother he is in the country the other one is not coming to pakistan and court send summon on his adress but he dont want to present in court.so if i won that case and in future my brother who is not in the country he can challenge again...the case.and as i know by self he dont want to come to pakistan and dont want to present in court.kindly advise me
