i have four sisters and a mother, my father has been passed away. we have a house in which me and my mother is living, all of my sisters are married and living in their houses. one of my sister is demanding the share in cash from the house in which me and my mother are living. legally she is eligible for the Share? if yes then what will be process to give her the share? presently the house is in the name of the father.

She is entitled to receive her share. You need a legal heir certificate declaring her share in the property. After that you need a surrender deed of her share in the name of other share holders and get it executed from the office under the jurisdiction of which such property falls. you can give her amount as share but do not forget to execute contract deed on Stamp paper between you and her, along with two , two witnesses . one of them must her husband. In agreement she must surrender her right or share of the property in your favour against that amount.
