''Bank Account Garnishment''

Recently I found out that my checking account had a writ of judgement served on the account by an attorney. This had the funds in the account frozen, and my paycheck which is is deposited directly also froze. The bank gave me the name of the attorney that served the writ on the account for judgement, and his telephone number. They also told me I have 20 days to resolve this issue with him. I have tried repeatedly to contact him to no avail. What should I do? I do not even know who the creditor is, or why or when the judgement was obtained. At This moment I have no money because of this-what are my recourses? Thanks.

In addition to checking the court website for information on the lawsuit/judgment, you could request your one-time-per-year free credit report from www.annualcreditreport.com and see what information about the debt/judgment is there.

It appears from your zip code that you reside in Philadelphia County. You can access the Philadelphia Court's Docket System at:

http://courts.phila.gov

From this page you can access the Court of Common Pleas search at the top right and the Muncipal Court from the middle of the page. This should provide you with more information about who commenced the action against you.

If you don't resolve the issue prior to the twenty (20) days, the attorney for the Plaintiff will seek judgment against the bank at which time the bank will pay the judgment from your account.
