Legal Question in Disability Law in Pennsylvania
Frequency of documentation for accomdation
I have been suffering from depression for over a year now. I have always worked from my home. A month after disclosing my depression to my manager, I was told that I had to report to an office. I went through the reasonable accomodation process. My treating physician did provide documentation, and I also was examined by an independent physician chosen by the company. My company then agreed to allowing me to continue working at home. However, they have been insisting that I provide documentation from my therapist on a monthly basis. My therapist did provide additional documentation and explained that depression is a long term illness and monthly documentation is not mutually beneficial. I received a letter back from my company demanding monthly documentation and threatened my employment status with the company if I do not comply. Is this considered to be discrimination? I understand that the company will need periodic updates, but I feel that monthly updates is an invasion of privacy. I am paying for the therapy sessions, and the request for documentation is taking treatment time away from me.

Generally, an employer can request updates on your condition to maintain the accommodation.
