Legal Question in Appeals and Writs in Pennsylvania
My husband was committ of a sexual crime that he did not committ. The judge is bias (does not like men) and we feel as though because of this he did not have a fair trail. She let the so called victims best friend bring in hear say (she was told by the victim). She told the jury to forget the dates and time line. There is way more to this trail and case and i do not feel comfortable putting it out there. However, we can not afford an attorney and had a public defender. We (my husband and i) feel as though the public defender did not do his job good enough. From the start he wanted my husband to plea and he didn't want to hear us avout the case unless we brought physical evidence to him. He did not ask questions he said he would ask. My husband requested a new public defender and was denied. Could someone please help us? My husband is looking at a lot of time and he truly did not do this. This girls is saying this out of jealousy.
1 Answer from Attorneys
The rulings you describe might have been correct or incorrect. I would need more information before I could say whether there are grounds for an appeal. But if there are, and if your husband still can't afford to hire a private attorney, he is entitled to a state-funded lawyer for his appeal. The public defender will be able to get that process started for him. But he will have to act quickly, as there are deadlines he must not miss.
Good luck.
