Legal Question in Appeals and Writs in Pennsylvania

Underage

2 years ago i got an underage i am currently 21 now. I got a letter in the mail stating that i owed the county 408 dollars for not going to classes. They recommended me to mental health when i went for a evaluation. I was put on probation for another conviction but i agreed to a year probation and completed that so everything is exponged. Since i got that letter i went up to the magistrate and told them that i was sent to mental health and that i'm off probation. The lady told me to go up and appeal the court order. I got a paper to send into penndot saying not to suspend my license. As of October 29th i got my license suspended by north huntingdon. An i didn't go to court for my appeal yet. Are they aloud to suspend my license and they did not give me a notice saying that my license was being suspended. I found out that my license was suspended when i went to go get a new license.

The type of situation you describe is complicated. You need to immediately get a restoration requirements letter and a copy of a ten year driving record. With these documents we can evaluate the current status of your license.

The general rule is that Penn DOT can do anything they want to do if you miss an appeal deadline. It is extremely difficult to do anything if the 30 day time period has expired. However, you can attempt to obtain permission from the Court of Common Pleas to file a statutory appeal late, i.e., nunc pro tunc. We can also file a Petition for an Administrative Appeal in Harrisburg to try to correct your driving record.
