Legal Question in Bankruptcy in Pennsylvania
My 81 yr. old mother has a Chase credit card, She took out a home equity loan from Chase Bank to pay the credit card off. The credit card balance is back up to 23,000 dollars and she has a different credit card owing 6,000, She is going to have to file bankruptcy, Can she file against the Chase credit card even though she has a home equity loan with Chase Bank? Bankruptcy discharges all unsecured debts. You cannot pick and choose which creditor will be discharged and the ones that will not. Secured debt, such as the home equity line will be treated differently from the Chase Bank card because the debt is secured by real estate.
