Bankruptcy Chapter 13

Do I have to list all my creditors and can I exclude any real estate transferred four years prior to filing?

You have to disclose all of your creditors. Recently I left one off because it was very small and only overdue for a short period of time and the Judge was very firm in telling me that it had to be listed. As for real estate transfers you have to disclose the information in your petition and the trustee may avoid transfers to insiders where the transfer was made within two years prior to the date the petition was filed and, in some narrow circumstances transfers made within ten years prior to filing the petition. Relatives of a debtor are considered to be insiders.
