Legal Question in Bankruptcy in Pennsylvania

Due to medical reasons

my husband has had 0 income for

the last 5 years. We have filed for

SSD, and just appealed and are

playing the waiting game. In the

mean time, we where served with

notices that we are

being sued by credit card companies.

We own our house ( inherited) and

little else. We did file bankruptcy in

1998 ( all debts where discharged)

to the wife's medical problems.

Can we file bankruptcy again even

tho it's not been 10 years? What

other options do we have?

You may probably file bankruptcy again, the limit is 8 years presently. However, before doing that, I suggest that you defend against the credit card company suits. They frequently claim interest that I do not believe they are entitled to and they frequently sue at a point where they are beyond the Statute of Limitations. Bankruptcy is difficult to file at present and attorneys are charging quite a bit for the new cases.
