If my husband files bankruptcy for his business, does that affect me?
I own my home and it is under my maiden name. My husband has a small business and is having financial difficulty. If he files bankruptcy, will this affect me? Will I lose my house? His business is not Inc..

One spouse can file for bankruptcy without the other, so your house would not be part of the assets of his bankruptcy estate. If you do not file jointly, however, joint debts (e.g., credit cards in both names or business debts for which you are also liable, such as an office lease guarantee) will not be extinguished by the bankruptcy.
