Legal Question in Bankruptcy in Pennsylvania

Hello,

In 1996 I had an motor vehicle accident, for which I was sued by an insurance company. I could'nt pay then and unable to pay now. That company has placed an hold on my drivers license in AZ. I have since moved to another state, but because of the hold I an not able to be licensed in any other state. My finances are still a mess. My question is can or will that judgement be removed if I declare bankruptcy?

If you file for bankruptcy protection, you would have to list that judgment as well as your other debts. You would send a copy of the Bankruptcy Petition, Schedule listing the judgment, and Bankruptcy Court case number to whomever is enforcing the judgment and insist they release the hold on your license. Once you obtain the bankruptcy discharge, you may have to file a motion with the court where the original judgment was filed to have it eliminated.

A bankruptcy will discharge the judgment. You can then submit the proof of the discharge to Arizona and they should lift the restriction. But check with them first to make sure.
