motion for relief and eviction process
My landlord went throught the court process of eviction on 10/25/02,after he burglarized my home on 10/18/02 and was arrested and charged. We were to vacate by 03/16/03. He had applied for writ of possesion on 01/05/03. I applied chapter 13 on 03/06/03 and was granted an automatic stay. He made an offer in writing for me to remain through 12/31/03 rent free if I dropped criminal charges against him for burglarizing my home on 10/18/02. I refused so he filed a motion to be relieved so he can evict me again.My question is,if granted relief will he have to go through the eviction process from the beginning or can he continue where he left off and have the sheriff's office evicted me immediately? I have also filed civil charges against him and have a court date set.
