Re: Paying Creditors
There is an automative stay against the creditors as soon as a bankruptcy petition is filed, and if a creditor wants to be paid, he must bring a motion and get permission from the bankrputcy judge.
Normally, a secured creditor, or a creditor whose debt will not be discharged, will be allowed to collect.
I strongly urge you to see a lawyer who can review all the facts of your particular case. If you cannot afford one, ask Legal Aid for help. Most bar associations also have a panel of lawyers willing to work for reduced fees.
Good luck!
