Legal Question in Bankruptcy in Pennsylvania
Reaffirmation
Dear Guru,
I have two accounts within my Chapter 7 case that I wish to reaffirm. I received an offer from one account and I want to accept it. What legal path must I take to stay right with the courts? Do the courts have to approve the repayment plan before I accept it? And if so, to whom do I mail the offer for approval?
Thank you...you guys are great!
Karen

Re: Reaffirmation
It depends on the judge you have. Some judges require that you strictly comply with the rule which requires that a motion be filed. Others are perfectly fine with your filing a reaffirmation agreement which has been signed by you and the creditor. The creditor will provide an agreement to you and you can sign it and return it to them.
