Reinstatement of mortgage with post-petition arrearages
I filed a chapter 13 bankruptcy in Sept 2002. Our payments to the trustee are current. In July, we made a late payment to our mortgage company. They motioned for and were granted a relief from stay. We tried to refinance, but the deal didn't go through. They were given a sheriff's sale date within two weeks of the relief from stay. I contacted the mortgage company with numerous requests for a reinstatement letter. When I finally received the letter, I discovered that the amounts are incorrect and they are including pre-petition arrearages in the amount to reinstate. I have tried to find an attorney to assist, but have been unsuccessful. I have also found that I have not been given credit for all of our payments. Can they do this?
