I am filing chapter 7 bankruptcy. I have a non interest bearing checking account that i do not wish to list in my bankruptcy filing papers. can the court trustee or the bankruptcy court find out about the checking account that i did not tell them about?. and is it beneficial to me to open up another checking acccount wait a few months and then file chapter 7. thank u in advance

Re: do i report a checking account at chapter 7 filing?

You must list the checking account asset on Schedule B, and of course the trustee can find out about it if you do not; your creditors would love to tell him or her. If you want bankruptcy protection, why risk losing it by engaging in fraudulent activity? The Bankruptcy Code lets you keep $5000 anyway and if you keep paying your mortgage and car loan, you likely are going to keep your house and car also.

This is general information for discussion purposes. We would have to have an attorney-client relationship for me to give legal advice.
