You may file a Chapter 7 Bankruptcy but not a Chapter 13.

bankruptcy procedure has become more complicated. Without income you will not qualify for a Chapter 13. Your income is determined not what you presently earn but when you file and your earnings during the six month period prior to filing. There are many other nuances you should contact an attorney to see if you qualify for a chapter 7.
