Legal Question in Bankruptcy in Pennsylvania
if i work can i still file ? am i able to even if i dont owm a home? help pleas
i work, but am i able to still file for bankruptcy? do you have to have a certain income level to be able to file?
i have 1 collection comp. taking me to court, but i have a few other creditors i have owed but have written me off on my credit report as profit and loss. will they be discharged as well?, even though they arent contacting me?
i dont own a home, but i do have 2 loans from my credit union. a car loan that i owe 6000 on and a loan for money to get work done on my car, which was 1900$ and i didnt have it.
will i still be able to keep my car and continue paying that loan? even though i work , i have a lot out there to be paid. my rent and utilities monthly and then car payment and car repair loan and now this collection comp.
i called the collection comp and asked about how to resolve this. they said i qwed 6500 but the original debt was only 4000. they said i could settle with 3500 in payments. but its too much for me each month to swing this. what can i do

As long as your disposable income, your income left over after paying your basic monthly expenses, is less than $300.00, you can file Chapter 7. Is sounds like that is the best option so that all your debts are addressed with finality and you obtain a fresh start.

The threat of a bankruptcy filing is often more effective then an actual filing. Before going into bankruptcy you should consult an attorney to review the pluses and minuses. I offer free consultations.

Yes, you can file for personal bankruptcy, even if you are working. In fact, the Trustee will review your bankruptcy schedules to make sure you have enough income to pay your monthly bills if the back debt is discharged. In general, you can keep the car if you continue paying the loan.
Your petition would be filed in federal bankruptcy court located in Center City Philadelphia. The typical bankruptcy case involves one appearance before the Trustee in Philadelphia.
If you want to retain me, we would need an initial meeting to review the matter and documents and then one more meeting to review and sign the bankruptcy petition and schedules. I have offices in Philadelphia and Wilmington and can arrange to meet either place. Please call or email me if you want to schedule an appointment.
