Legal Question in Business Law in Pennsylvania
About 4 years ago I had planned on having liposuction done, I got the funding through a credit agency..the night before I was scared to get it done and I cancelled the appointment. The whole surgery has been paid for. I went in yesterday for another consultation planning to go through with it this time. The doctor was going to do the surgery and charge me the same price as I was approved for, but will not use the money that he was already rewarded the first time. He wanted me to pay all over again because I cancelled at the last moment. Do I have a case? He got paid in full for services he did not provide at the time and will not accept my previous payment for this time.

You should read the surgeon's contract. Does it state that if you cancel before a certain period, then the fee is nonrefundable? Even so, you probably have a claim against the office. The office was paid for a service that they did not provide. You may also have a claim for unfair trade practices and violations of other Pa consumer protection laws. At the minimum, you are probably entitled to a refund. I am happy to help you if you need more help. Good luck.
