Breah of Contract & Possible Harassment

A woman wanted to buy a kitchen from us for $1200. I advised her that it was in rented storage and we needed it moved asap, within a week if possible. She sent a $400 deposit via Paypal (unrequested). After approximately 3 weeks, I told her we needed the space; she'd have to remove it. I offered to return her deposit if she would let me know at that time that she did not want it. She failed to respond, so we rented additional storage to hold it. I then gave her a deadline of March 28, 6 weeks from the agreed date of purchase. On March 27, she told me she didn't want it. She now wants her $400 deposit returned. I offered to return $200 - applying the remaining $200 toward the cost of storage. She refused.

Additionally, she was recently suspended from ebay (completely unrelated). For some reason, she blames me and has threatened to sue over it (I had nothing to do with it). She continually emails me with accusations. For example, on Easter, she emailed me at 12:02 (midnight); when I didn't respond (I was asleep), she sent at message 2AM asking if my silence (at that hour!) was an admission of guilt. She went on to email me 3 more times that day - and had emailed me 5 times the previous day.

Help! I don't know what to do.

A letter from an Attorney will normally do the job, however, if this person continues to act in this harrassing manner you can also move forward with a possible criminal suit as well as a civil suit.

You probably should sue in District Court for Breech of Contract. You should attempt to sell the item and the difference between what she offered ($1200) and what you get are your money damages along with the cost of the storage until it is sold. I offer free consultations.
