charitable sales promotions

Many states have regulations regarding charitable sales promotions operating in their states. If my promotion is internet based, am I outside of these regulations, or must I adhere. My contention is that I am not operating in these states, therefore I am not bound by these regulations.

You asked about foreign jurisdiction.

This is a gray area, but to put it simply, a business is considered to be doing business in any jurisdiction which s/he solicits or accepts business. In other words, if you have a Web page open to the world, then you may be selling to the world. But if you restrict your sales to Pennsylvania then you could be considered as doing business in PA. But if you also make occasional sales to other states you may be doing business in those states.

There is a general exception for unique sales, but again, that's an exception and often apply.

You should speak with an attorney and do a review of your risk exposure regarding your business model. I would be happy to work with you on this matter.
