Legal Question in Business Law in Pennsylvania

contract clause re non compete

I was left go by a Company who now threatens action because I am working for a similsr company and contacting old customers.

They cite a clause in an agreement '' By the signature to this document , IC (independent contractor) agrees not to engage in advertising sales related to any

------------ products etc,etc

I had always heard that while this is a common contract clause it will not stand up in court ?

Re: contract clause re non compete

Non-compete provisions in Pennsylvania are typically enforceable, provided that the scope and timing of the prohibition is "reasonable" within your particular industry. The "etc, etc" portion of your post probably includes those parameters.

If you'd like to discuss those terms in further detail, please feel free to contact me.
