Contract & no Refund Policy

Last night I signed a contract with ''Buy Owner'' to help sell my home. They are a marketing company. The fee is $4,000 and I gave them a deposit of $200 to purchase a loan through their creditor. I thought I had 3 days to cancel any contract. I see in small print it is a No Refund Policy. Can I still cancel within 3 days and not lose any money? I am going to put a stop payment on the check. Thanks!

You asked if you could cancel a representation agreement with a home selling company.

Generally sales of property are non-concellable the moment the offer is accepted and enforceable when signed. Here you have an agreement for services associated with the sale of a property. You may have the option to cancel but it would irrsepnsible for anyone to give advice without reading the agreement and checking the law specifically.

Also, it is extremely problematic to try to solve a problem by stopping payment on a check. There are other avenues that are more appropriate and without the legal ramifications.

You should consult with a local attorney to discuss your options and plot a course of action.
