Contract with a Web Development Company is based on fraudulent information
I entered into a contract with an Indian web development company whose proposal was based on fraudulent information regarding a past client. They completely lied about the fact that developed a very impressive website for a U.S. company. Although I got 2 other quotes from other development firms, my decision to go with the Indian firm was based solely on the fraudulent information that they provided me. As it turns out, they never worked on the site that they stated they worked on and merely discussed providing services to that U.S. company. Additionally, they will not release the source code to me even though the contract states that it is my proprietary property. How should I proceed? There are elements of contract, intellectual property and criminal or civil (the fraud) law here. I realize it's complicated. Any direction would be appreciated.

Ultimately, the terms of your agreement with this company will dictate your rights and remedies. Of course, I would need to review the document in order to advise you. The overriding risk here is that the company is based in India, which makes it extremely difficult to enforce whatever rights you do have. Please feel free to contact me if you'd like to discuss.
