Can a person who owns a restaurant and is incorporated be sued for discrimination if he/she refused service to a person?

You asked if a small business (restaurant) can be sued for discrimination.

It is illegal to unlawfully discriminate against a person because they belong or appear to belong to a protected class.

There are many reasons for which it is lawful to discriminate against a person. But when a person is discriminated against for membership in a protected class then yes, suit may be brought under various civil rights acts.

Lawyers like these cases because they are often interesting, help define the rights of persons, and usually have an award of attorney fees when the person discriminated against wins.
