Ex-Employee trouble
Hello, my husband and I own a small business. We have three other employees. We were scheduled to be out of town for three days and decided to let the business remain open, so the employees would not miss any work. We left the manager in charge. One employee went out of control on the first day, arguing with the manager, bad-mouthing my husband and I to our patrons, ultimately, she decided to copy down all of our clients names and numbers from our computer system, packed up her things and left. I have since recieved a phone message from her saying she is going to return to our business on pay day to pick up her paycheck. My question is, I do not want this person back in our business, especially since our manager said she does not want to face this girl again. Should I call her and tell her I will mail her the paycheck, and what should I do about her calling our clients and the stolen information she has? I am walking on eggshells because she has already stated that she has sued former employers and she has retained an attorney. ( she has given me no reason for this, only that we are ''unprofessional'') I have not yet contacted this employee, since I want to do everything lawfully. thank you

You asked about an ex-employee that may be trouble.
You need to speak with an aggressive attorney immediately. There are two issues that I see. Can you mail her paycheck. Yes, and in fact it is a must that you do so. Do it by certified mail, return receipt requested.
Second, you must protect your business from whatever this employee has, is or may do with regard to your customers. This is where you really need an attorney. No employee may take proprietary information and doing so can bring harsh damages and penalties. but getting the cat back in the bag is tough. An aggressive attorney acting now may save damage to your business.
