It depends on what funds where misused. If it is fraud or breach of fiduciary duty, the statute of limitations is 2 years. But if it breach of contract the statute of limitation is 4 years. If the misuse of funds involved an estate, the statute of limitations is 6 years generally depending on the specifics of the situation.
The statute of limitations starts when the person discovered or should have discovered the misused funds. Ignorance or failure to monitor one's affairs is not an excuse.
On the other hand, if the misuse of funds is a criminal act, the the limitations are different. You will have to consult a criminal attorney for those rules.
