Ding, ding, ding! You asked the $64,000 question. When doing business on the Internet what state's laws apply?
This is an area of ongoing contention among parties, legal professionals, the judiciary and legislative bodies all over the country.
Cases are all over the road on this. The best answer that I can give is that the law which best serves my client's interests are the laws that I will make apply to the transaction. That is the essence of my job as a lawyer.
I know it doesn't help but this is the best answer I can give you.
