Labor contract
My roof was worked on and the service was guaranteed for 3 yrs. I received an estimate in writing with the 3 year guarantee. I have my cancel check showing I paid for the service. Less than a year later the roof began leaking again- the roof came out and said that he fixed it ;however
it is still leaking . The roofer is avoiding me and is giving excuses not to come out and fix the roof. What are the chances of recovering my money in court? Would I go to
small claims court? The amount is 375.00 + 65.00 damage that was caused inside the house.

You need an expert witness to testify that the roof was not repaired properly. If you can establish that fact then you have two years from the date of completion of the roof to file a claim for loss. The two year statute applies to negligence of the roofer. You have a claim for repairs of the roof up to three years. Gerald Hershenson 215-579-9390
