Re: photography

Photography is one of my hobbies and I do some portraiture work on occasion, so I know that there can be a mismatch in reading the client's mind. There was recently a case brought by a bride and mother against a photographer because he failed to adjust her tiara in the photos and it appeared tilted on her head; he ultimately prevailed (See this month's issue of 'Professional Photographer').

Here, the answer to your question will depend largely on what is in the agreement that you signed with the client (which may or may not be the bride), or the verbal agreement that exists if you don't have a written agreement. Client remedies should be a section that is spelled out in the agreement. If not, you should be documenting everything carefully. Can she sue you? Yes. A party can sue for any reason; but whether she is victorious or not depends on how well you document and present your facts. It appears that you are making attempts to resolve the issue with her, and that is a positive step in the eyes of the court. Don't rule out the fact that she may be low on cash or is just trying to negotiate a lower price.
