Physician non-compete
Seven years ago, I signed a contract which included a restrictive covenant with my employer. He recently sold his office-based practice to a group that I chose not to sign a contract with for a variety of reasons. In effect, he down-sized my position, keeping me on for nursing homes only. In doing so, he admitted, to me and other staff members, that the reason for keeping me on in that capacity is to prevent me from competing against the new group, for which he will become an employee. I have other full-time offers for employment in the area. I have been in contact with my lawyer and others. But can I explore the enforcability of the non-compete with the court before taking an offer for employment?

Yes, you could seek a declaratory judgment. However, depending on what the no compete clause says this may or may not be a wise idea.
