Purchasing on the Internet

A family member (from Ohio) bought a product off the internet. Before purchasing the product, he contacted the seller (from PA) by phone. The seller assured him several times that the product was in good working order. The cost of the product was $7000.00 + $500.00 in shipping. When the product was delivered, the product not only looked bad but was not in working order. In fact some of the parts were not the parts that were promised in both the online ad and also by the seller on the phone. When the seller was contacted after the delivery, he said that the original seller (a third party) had assured him that the product was in great working order. The seller has said that he will refund $2500 of the original $7500 + parts. However we are not sure if the individual will come through. What can we do about this? Should we take the seller to small claims court? Do we sue? How are we protected?

Since the people you're dealing with are out of state -obtaining a judgment in Ohio over them, and then enforcing it in Pennsylvania will be a chore and may not work - dangerous to deal in these circumstances - if it doesnt work you may have to go to federal court.
