Recovery of money

Hi,

I'm from India. I had give a second had some machinery to a friend of mine who promised me that he would sell it for me for $4000 within 30 days. Instead this person went away to USA after selling the machinery without paying me anything.

After about 15 months I managed to get his email address and so I began corresponding. But he says that he had agreed for only $2000 and that he would pay that over a period of 6 months in instalments.

I got upset and stopped correspondind with him.

After 1 year I started contacting him and he again says the same old thing.

My question is is there any way I can proceed legally to recover my amount as well as the interest. Presently he is living in Philadelphia, USA.

As a proof I have an acknowledge letter of receipt of machinery give and signed by him. Can we use the email correspondence as a proof?

I shall appreciate if you extend all possible help in this regard.

As per your facts, the acknowledgment does not talks about the value of the machine nor does it talks about the time period for payment of your money. It all depends upon the language of the acknowledgment.

My advice is to take $2000 from him or else file a recovery suit against him as the contract is formed and executed in India. The court will appoint somebody to value the machine. It a long process.

You are going to face the lengthy procedure of the law.

I would advice you to file a recovery suit against him and rest of the process will be done by court and the court will appoint commision to value the machine.
