Legal Question in Business Law in Pennsylvania
I am considering taking a position with another company that is presently an OEM customer and my intent would be to preserve this relationship. My present company also competes with them. I am concerned about a restrictive covenant and if it is enforceable?

Generally, yes, restrictive covenants are enforced by the courts in Pennsylvania. A court will enforce it if was executed to induce the company to hire you, and if the restrictions are reasonable under the circumstances regarding time and geographically limitations. Exactly what is reasonable is determined on a case-by-case basis and depends on the kind of business and the position you held with your former employer. I encourage you to take the agreement to an attorney licensed in Pennsylvania to get specific advice tailored to your situation.
Good luck.
