Legal Question in Civil Rights Law in Pennsylvania
Can my wages be garnished in PA on a default judgment ordered in NY on a commercial building lease?
1 Answer from Attorneys
It kind of depends here on facts which you do not relate. Were you sued in NY or PA? Where do you work? Who is your employer? Is it government or a private employer?
NY allows wage garnishment - 10% of your disposable pay can be garnished. PA has no wage garnishment except for back rent owed to a landlord but only for a residential lease, not commercial?
If you live in PA and work in PA for a purely PA employer AND if the judgment was entered in NY solely, then your wages cannot be garnished. If this is a PA judgment then your wages also cannot be garnished. However, if your worked in NY and a PA judgment was entered, it could be transferred to NY and then enforced as it were a NY judgment.
If your employer is in NY and its a NY judgment then your wages can be garnished. If your employer is headquartered in another state then it will be up to the employer as to whether they will honor an out-of-state judgment. Some employers will do that regardless of the fact that PA does not allow wage garnishment.
