Legal Question in Civil Rights Law in Pennsylvania

My wife was involved in an auto accident 1/11/11 by no fault of hers and today the other insurance company notified us they were totalling her 2007 Lincoln MKX. The dollar amount they are offering is less than expected. NADA is $28,275 and they are offering $27,049 which they say includes sales tax. Their argument is that PA is a not a single choice state for auto values and they are relying on J. D. Powers printout which we have not seen that says there are ten vehicles in the area for sale with similar mileage for an anvenrage cost of only $23k and that number averaged with the NADA is around $25k and when you add sales tax you get the $27,049.76. There is way our vehicle was only worth $27L including sales tax. What recourse do we have? There is a personal injury claim also which we are not even talking about yet. We just feel we are getting screwed by Progressive on this matter
