Is it illegal to access your spouse's email account and to view the emails they have received without their approval but you knew their password for the email account?

You asked if it is illegal to access a spouse's email account.

There is wide latitude for interpretation of the current unlawful computer access laws but generally it would not be illegal to check a spouse's email account. Really, really stupid, but probably not illegal.
