email theft for business

A former employee has been logging into our email server under various current employee names and passwords to steal email about clients and leads. This ex-exployee then used this information to try to contact our clients to try to get them to switch over to his new comapny. Stated in his contract he is legally unable to contact our clients if he leaves the job, but is this a cyber crime? and if so, what would it fall under?

It's probably a cyber crime, a violation of some of the newer statutes about electronic privacy.

But it's also an old-fashioned breach of contract and unfair competition case, which courts have been handling for centuries. As far as a civil remedy, the use of the computer is not terribly significant; it adds a little spice, but if the contract contains a non-compete, he'd be in violation no matter how he obtained the info.
