Video taping without permission
Is it legal for a resident to video (from his upstairs window) employees working in the employer's private property?

This is NOT a constitutional question. Its covered by the wiretap statute. Essential you can not make a sound recording of another without that parties permission. That includes over the phone or in person.
It also forbids video taping with sound though there are exceptions.
The question is why on earth would you want to video tape them?
